Terms of Service

Who we are, and what you’re agreeing to
Phenomenal is operated by PTO Pro, Inc., a Delaware corporation. These terms are an agreement between you and PTO Pro, Inc. that applies whenever you use Phenomenal — whether you run an organization’s site, volunteer for one, pay dues to one, or simply buy a shirt or make a donation through one.
By creating an account, making a purchase or donation, or otherwise using the platform, you accept these terms. If you are acting on behalf of a PTO, PTA, booster club, independent club or league, school, or district, you confirm you have the authority to bind that organization, and “you” includes it.
What Phenomenal is
Phenomenal gives community organizations — parent-teacher groups, booster clubs, independent clubs and leagues for every age group, and the schools and districts that oversee them — a branded website plus the tools to run their year: fundraising and donations, membership and participation dues, a spirit-wear store, events and volunteer signups, communications, and record-keeping. Each organization’s site is that organization’s own — we provide the platform; the organization provides the content and runs its own operations.
Your account
Accounts sign in with passkeys or sign-in links sent to your email — we never see or store a password. You are responsible for the devices and email address that can access your account, and for what happens under it. Keep your account information accurate, and tell us promptly if you believe your account has been compromised.
Payments, donations, and purchases
Payments on Phenomenal are processed by Stripe. When you buy something from or donate to an organization on the platform, the organization — not PTO Pro, Inc. — is the merchant of record: your payment goes to that organization’s own payment account, and PTO Pro, Inc. collects a platform fee from the transaction.
Prices, shipping, and any sales-final or refund terms for a purchase are shown at checkout. Spirit-wear orders are produced on demand by our print fulfillment partner; if an order cannot be fulfilled, it is refunded in full. Donations are voluntary payments to the organization you chose; whether a donation is tax-deductible depends on that organization’s own status, and we make no representation about it.
Acceptable use
Use the platform for what it is: running and supporting community organizations and the people in them. Don’t misuse it — no unlawful activity, no infringing or deceptive content, no harassment, no attempting to break, probe, or overload the service or to access data that isn’t yours. We may suspend or remove accounts, content, or organizations that violate these terms or put other users at risk.
Your content
Organizations and their members own the content they publish on their sites. By publishing it through Phenomenal you give us the license we need to host, store, display, and deliver it — that’s the whole purpose of the license, and it ends when the content is removed. You are responsible for having the rights to what you publish.
Disclaimers
Phenomenal is provided “as is” and “as available.” We work hard to keep it reliable, but we don’t promise the service will be uninterrupted or error-free, and we are not a party to the relationship between an organization and its members, buyers, or donors. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, PTO Pro, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the platform. Our total liability for any claim relating to the service is limited to the greater of one hundred dollars ($100) or the platform fees we received from your transactions in the twelve months before the claim arose.
Termination
You can stop using Phenomenal at any time, and an organization can close its account. We may suspend or terminate access for violations of these terms, for legal reasons, or if the service is discontinued — with reasonable notice where practicable. Sections that by their nature should survive (like ownership, disclaimers, and limitation of liability) survive termination.
Changes to these terms
We may update these terms as the platform evolves. If a change is material, we will give notice — on this page, in the product, or by email — before it takes effect. Continuing to use Phenomenal after a change takes effect means you accept the updated terms.
